Terms of Service
BruhnBruhn Innovation AB
Last updated: April 2026
1. Acceptance of Terms
By accessing or using the Dacreo portal at dacreo.io (the “Portal”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Portal. These Terms form a legally binding agreement between you and BruhnBruhn Innovation AB (BBI), a Swedish limited liability company.
2. Description of Services
The Portal provides two categories of access:
2.1 Documentation Access. Registered users may access product documentation for the Dacreo product family, including Dacreo apto and DacreoOS. Access requires a valid user account. Documentation is provided for reference purposes to support evaluation, integration, and operation of Dacreo products.
2.2 Licensed Technology Access. Users holding a valid Dacreo license key may access a restricted subsection of the Portal containing technical specifications, software artifacts, and related materials. Access to this subsection is conditioned on accepting the terms of your applicable license agreement in addition to these Terms.
3. Export Control Notice
3.1 Controlled Technology. Certain content accessible through the Licensed Technology subsection of the Portal constitutes controlled technology under Regulation (EU) 2021/821 (the EU Dual-Use Regulation), specifically Category 9D005 (software specially designed or modified for the operation of equipment specified in Categories 9A or 9B). This content is hereinafter referred to as “Export Controlled Content.”
3.2 End-User Certificate Requirement. Access to Export Controlled Content requires you to submit a valid End-User Certificate (EUC) to BBI prior to access being granted. The EUC must identify the end user, the end-use application, and the country of end use. BBI reserves the right to refuse or revoke access if the information provided is incomplete, inaccurate, or inconsistent with applicable export control regulations.
3.3 User Acknowledgement. Before accessing Export Controlled Content, you must complete an in-portal acknowledgement confirming that:
You have read and understood the export control classification applicable to this content.
You are not located in, and will not transfer this content to, a country subject to EU, UN, or applicable national sanctions or arms embargoes.
You will not use the content for any end use prohibited under applicable export control law, including but not limited to weapons of mass destruction programs.
You accept full responsibility for compliance with all applicable export control laws and regulations in your jurisdiction.
This acknowledgement is recorded and associated with your account. It does not constitute an export license. It is your responsibility to obtain any required export or re-export authorization from the relevant national authority before transferring controlled technology to third parties.
3.4 No Implied Authorization. Access to Export Controlled Content through the Portal does not constitute an export authorization or a determination by BBI that no license is required. BBI makes no representation regarding the legal requirements applicable to your specific use or jurisdiction.
4. User Accounts
4.1 Registration. Access to the Portal requires a registered account. You are responsible for providing accurate and current information during registration and for maintaining the confidentiality of your credentials.
4.2 Account Security. You are solely responsible for all activity occurring under your account. You must notify BBI immediately at portal@dacreo.io if you become aware of any unauthorized use of your account.
4.3 Eligibility. You must be at least 18 years of age and have the legal authority to enter into these Terms on behalf of yourself or, where applicable, your organization. If you register on behalf of an organization, you represent that you have authority to bind that organization.
5. Acceptable Use
You agree not to:
Share your account credentials or license key with any third party.
Circumvent or attempt to circumvent any access control or export control mechanism.
Reproduce, distribute, or disclose Export Controlled Content to any person or entity without prior written authorization from BBI and any required government authorization.
Use Portal content to develop competing products or services without BBI’s written consent.
Attempt to reverse engineer, decompile, or disassemble any software made available through the Portal.
Use the Portal in any manner that violates applicable law, including export control law, data protection law, or intellectual property law.
6. Intellectual Property
All content made available through the Portal, including documentation, software, trademarks, and technical specifications, is the property of BBI or its licensors and is protected by Swedish, EU, and international intellectual property law. Dacreo® is a registered trademark of BruhnBruhn Innovation AB. No content may be reproduced, modified, or distributed without BBI’s prior written consent, except to the extent expressly permitted under your applicable license agreement.
7. License
Subject to these Terms and, where applicable, your license agreement, BBI grants you a limited, non-exclusive, non-transferable, revocable right to access and use Portal content solely for your internal evaluation or operational purposes in connection with Dacreo products. No other rights are granted.
8. Limitation of Liability
To the maximum extent permitted by applicable law, BBI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Portal or its content, even if BBI has been advised of the possibility of such damages. BBI’s total aggregate liability shall not exceed the fees, if any, paid by you to BBI in the twelve months preceding the claim.
Nothing in these Terms limits liability that cannot be excluded under mandatory Swedish or EU law.
9. Indemnification
You agree to indemnify, defend, and hold harmless BBI, its officers, directors, and employees from and against any claims, liabilities, damages, and costs (including reasonable legal fees) arising from your use of the Portal, your violation of these Terms, or your violation of any applicable law, including export control regulations.
10. Termination
BBI may suspend or terminate your account and access to the Portal at any time, with or without notice, if BBI reasonably believes you have violated these Terms, any applicable export control regulation, or any applicable law. Upon termination, the obligations in Sections 3, 5, 6, 8, and 9 survive.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of Sweden, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the Swedish courts, with the District Court of Västerås (Västmanlands tingsrätt) as the court of first instance, unless mandatory EU consumer law requires otherwise.
12. Changes to These Terms
BBI may update these Terms at any time. We will notify registered users by email or through the Portal when material changes are made. Continued use of the Portal after the effective date of the updated Terms constitutes your acceptance of the revised Terms.
